The Fair Labor Standards Act requires employers to pay employees overtime if they work in excess of 40 hours in a week. The overtime rate is one and one-half times the regular rate of pay. If the employer fails to pay overtime, then the employer must pay the employee's back wages of one and one-half times, and also pay the employee's attorney's fees.

Fair Labor Standards Act Violations

The Fair Labor Standards Act is a federal law that requires an employer to pay overtime at a rate of one and one-half times the employee's regular rate of pay, if the employee worked in excess of 40 hours in a week. The Fair Labor Standards Act prohibits the overtime requirement from being waived.
