The Fair Labor Standards Act requires employers to pay employees overtime if they work in excess of 40 hours in a week. The overtime rate is one and one-half times the regular rate of pay. If the employer fails to pay overtime, then the employer must pay the employee's back wages of one and one-half times, and also pay the employee's attorney's fees.
However, there are certain minimum wage exceptions that may apply. Therefore, you should know your legal rights. If you believe you have not been paid extra for overtime work, contact Fuller, Fuller & Associates, P.A.
