A nursing home resident, or in certain instances, the loved one of a nursing home resident, may recover for pain and suffering incurred by the nursing home resident as a result of the negligence or neglect of the nursing home. Examples of negligence or neglect include overuse of medication, prolonged deprivation of food and water, failure to timely provide medication, and failure to turn or rotate the nursing home resident in bed. Punitive damages may also be awarded in extreme cases as punishment for outrageous conduct by the nursing home or its employees.
Some examples of injuries to nursing home residents are malnutrition, fractured bones, dehydration, and bedsores.
Legislation has been passed to protect the elderly from neglect and abuse in nursing homes that can lead to serious injuries, wrongful death, bedsores and broken bones.
